1. Who is responsible for data processing?

medica wants you to feel safe with respect to your personal data and to be informed about what personal data relating to you is processed, as well as when and for which purpose.

It reserves the right to amend this Privacy Policy where necessary from time to time. You can find the respective current version on our website at www.medica.ch.

 

 

2. What personal data is processed?

 

2.1 Which categories of personal data are processed, when and for what purpose?

To be able to provide you with our (medical) services and charge for these services, we process the following categories of personal data:

 

  • During patient admission, we process your contact details, identification data and information concerning invoice recipients (e.g. full name, address, e-mail address, date of birth, gender, cost bearers).
  • A personal or electronic communication with you requires the processing of your contact details and, where necessary, your identification data (including copies of ID) or information or information concerning invoice recipients.
  • When evaluating materials for analysis, we process the health data derived from the materials for analysis such as (blood) values and create medical reports based on this data.
  • It is also possible that your doctor or another healthcare specialist may transfer data about you to us that they have collected in the course of providing you with treatment with your consent for processing, in particular for the purpose of carrying out laboratory analyses.
  • For payment on site or invoicing, we process your financial and contact details or the contact details of your insurance company, depending on the invoice recipient (e.g. credit card number, invoice amount). If our invoice is not paid on time, we may forward your personal data and, if necessary, health data to a debt collection company.
  • On request or where necessary (see section 3), we will forward the results or reports to your attending doctor or a third recipient. To do this, we will process both your health and contact details.
  • The categories of personal data processed in the previous points may be processed or stored to comply with legal requirements.

 

2.2 How long will we process your personal data for?

We will only process and store your personal data for as long as is necessary to provide you with our (medical) service. In all other cases, we anonymise or delete your personal data, with the exception of:

  • The completion of statutory retention periods and compliance with statutory periods of limitation, usually between 10 and 20 years (30 years in the case of genetic data).

 

3. Will your personal data be disclosed to third parties?

There are certain tests (which are indicated as such on the application form) that we cannot carry out in our laboratory, in which case we commission external laboratories in Switzerland or the EU and send the material for analysis to them.

If you were referred to us by your attending doctor, then we will also disclose personal data to them. We will also forward a copy of your results to recipients specified by you, but only if you request us to do so.

If the invoice is to be sent to your health insurance provider, we will disclose to your provider the personal data needed for this purpose as well as the item numbers for the charge. If, on the other hand, you pay by card on site, only your card details will be forwarded to the financial entity in question by the card reader. If our invoice is not paid on time, we may forward your personal data and, if necessary, health data to a debt collection company.

As a basic principle, our suppliers have no access to the personal data of third parties, in particular patient data. If, in exceptional cases, in the course of carrying out the contract, a supplier requires access to personal data, we will put in place corresponding contractual agreements to ensure data protection.

If necessary for or conducive to answering your query or providing you with a medical service in a laboratory (including transferring results by electronic means), we may forward your data to a medica company affiliated with the laboratory or an external service provider. They are obliged to process the data exclusively on our behalf and in accordance with our instructions and must comply with the applicable data protection requirements.

Data is only ever forwarded to authorities or government institutions if required by law, such as obligations to report infectious diseases or in response to a court or official order.

 

4. Will your data be transferred abroad?

Your personal data will only be forwarded to external laboratories located in the EU in the cases specified in section 3. These have very high standards of data protection as they are subject to the European General Data Protection Regulation, which is generally speaking stricter than Swiss data protection law.

 

5. What are your rights?

 

5.1 Right to information

You can request information from us as to whether personal data about you is being processed; who the controller is; which personal data is being processed; what the purpose of the processing is; how long the retention period is or the criteria for setting this period; how the personal data has been obtained; whether automated individual decision-making is used and the logic underpinning it; and the recipients or category of recipients to whom personal data is disclosed.

 

5.2 Right to data portability

In accordance with Art. 28 FADP, you may request that the personal data you have disclosed to us be copied or forwarded to you in a commonly used electronic format.

 

5.3 Revocation of consent

You may revoke your consent to processing at any time without giving a reason. The revocation shall apply to all future processing of the personal data in question. However, we may no longer be able to complete your order if the personal data is necessary to carry it out.

 

5.4 Rectification

You may request that incorrect personal data be rectified, unless the law forbids this.
